Charged as a Young Person?

If your child or teen is facing criminal charges, it’s important to act quickly. The Youth Criminal Justice Act (YCJA) provides different rules and protections for young people, and TC Legal knows how to navigate this specialized system. We defend minors charged with offences such as theft, assault, drug possession, and mischief.

We focus on protecting your child’s future, minimizing exposure to the justice system, and avoiding long-term consequences like a permanent record.

FAQ

frequently asked questions

What age is considered a “young person” under the law?

Anyone between the ages of 12 and 17 at the time of the alleged offence is covered by the Youth Criminal Justice Act.

Will this go on my child’s permanent record?

Youth records are treated differently and often have expiry periods. We work to keep the offence from affecting future opportunities.

Can my child be held in custody?

Yes, but only under strict conditions. Detention is a last resort for youth and we’ll fight to keep your child home and supported.

Are youth trials different from adult trials?

Yes. Youth trials are generally held in private, and sentencing focuses more on rehabilitation than punishment.

What if my child admits to the crime?

We can still help reduce penalties, protect their rights, and pursue diversionary programs to avoid a criminal record.
