What are the different types of assault?

Assault charges range in severity:

  • Simple assault: this could include a fist fight or shoving
  • Assault causing bodily harm: this would include an assault that escalated to the other party being injured in a non-trivial manner
  • Assault with a weapon: this includes an assault where the use of a weapon was threatened or carried out 
  • Aggravated assault: this is an assault that resulted in serious injury that wounded, maimed, or disfigured the other party.

Can I be charged even if the alleged victim wasn’t injured?

Yes. Threats, attempts, or even gestures can result in charges depending on the context.

What is the penalty for domestic assault in Alberta?

Penalties vary but may include fines, probation, no-contact orders, or jail. A conviction can also affect child custody or immigration status.

Can the charges be dropped if the victim changes their mind?

Only the Crown Prosecutor can withdraw charges, but the victim’s cooperation is a factor they will consider. It is important for you to comply with all no contact conditions imposed and to not interfere with the victim or you could face additional charges, including obstructing a witness.

What defences are available in assault cases?

Self-defence, mistaken identity, consent (in mutual fights), and lack of intent are common defences we explore.
