Does a DUI Show Up on Your Passport

If you have been charged with or convicted of a DUI and are planning to travel, it is normal to worry about whether that offence will appear on your passport. Many people in Calgary and across Alberta ask this question before booking flights or crossing borders.

The simple answer is no. A DUI does not appear on a Canadian passport. However that does not mean a DUI has no impact on travel. Understanding how passports work and how border authorities check criminal history is essential.

At TC Legal, we regularly advise Calgary clients on impaired driving matters and how those cases may affect international travel.

What Information Is Stored on a Canadian Passport

A Canadian passport is a proof of identity and citizenship. It contains your name, date of birth, photo, passport number and nationality. It does not list criminal offences, DUI charges or convictions.

There is no section on a Canadian passport that displays criminal record information. Anyone who looks at or scans your passport will not see a DUI.

Can Border Officials See a DUI Anyway

Although a DUI does not show up on your passport, border officers may still access criminal record databases that are separate from passport information.

When you travel, especially internationally, border agencies may run background checks using law enforcement systems. These systems can include criminal convictions depending on the country and its information sharing agreements.

For example, Canadian border officials and foreign border agencies may be able to see a DUI conviction even though it is not written on your passport.

Does a DUI Affect Getting or Renewing a Passport

In most cases, a DUI does not prevent you from applying for or renewing a Canadian passport. Passport Canada does not normally deny passports based on impaired driving convictions.

However there are limited exceptions. If you have outstanding warrants, court ordered travel restrictions or unresolved criminal matters, your ability to travel may be restricted even if your passport is valid.

These restrictions are related to court orders rather than the DUI appearing on the passport itself.

Travelling Outside Canada With a DUI

The real concern for many people is not the passport but whether another country will allow entry.

Each country has its own immigration rules. Some countries may overlook a DUI while others may treat it as a serious offence. The United States is a common concern for Calgary travellers. US border officials have discretion to question or deny entry depending on the circumstances of a DUI and your overall record.

If you are required to apply for a visa, you may be asked to disclose criminal history. Failing to answer honestly can result in refused entry or future travel issues.

DUI Charges Versus Convictions

There is an important difference between being charged and being convicted.

A charge that is withdrawn, stayed or dismissed may have less impact on travel than a conviction. Convictions are more likely to appear in criminal record databases that border officials can access.

This distinction is especially important for people in Calgary who are currently facing impaired driving charges and are concerned about future travel.

What Calgary Drivers Should Do Before Travelling

If you have a DUI charge or conviction and plan to travel, it is wise to prepare in advance.

Check the entry requirements of your destination country
Answer all immigration questions honestly
Understand that border officers have discretion
Seek legal advice if you are unsure about your admissibility

Every situation is different and travel outcomes are never guaranteed.
